Section 3.1. The Membership of the corporation shall consist of 2 types of Members.
a) Active Members: Any person who believes in Allah (SWT) and His Oneness, all His Angels, all His revealed Books, all His Prophets, The Last Day, and Allah's Divine Preordainment and Decree; and believes that Muhammad (SAW) is the last prophet, the Quran is the last divine book for humanity and the Sunnah of Muhammad (SAW) is the example of how one should live their life, is eligible to become an “Active Member”. Additionally Active Members must be 18 years or older and must be legal residents of Dakota, Ramsey or Washington counties in Minnesota or legal residents of Saint Croix, Pierce or Dunn Counties in Wisconsin. Active Members who fulfill the above requirements shall further consist of two sub-types. Annual Active Members shall be subject to a payment of a Membership Fee and any other administrative process as determined by the Board of Directors. Lifetime Active Members shall become Active Members of ISW-EM for a lifetime by making a one-time payment equivalent to 40 times the regular annual membership fee.
b) Any person who is not an Active Member or who is a non-Muslim, is eligible to become an “Associate Member” subject to the approval of the Board of Directors. The Board of Directors reserves the right to decline an Associate membership, with or without cause. “Associate Members” do not have any voting rights. Associate Members may be subject to a payment of an ‘Associate Membership Fee’ as determined by the Board of Directors.
Section 3.2. Active Members are entitled to vote and all Active Members shall have equal rights and preferences as defined in the Bylaws.
Section 3.3. The term of Annual Membership shall be one year. Annual Membership shall terminate at the end of the stated term of Membership unless renewed within 90 days of the membership expiration date with payment of any outstanding membership dues.
Section 3.4. Membership shall automatically and immediately terminate on any felony conviction under Federal or Minnesota law.
Section 3.5. Membership shall also be terminated in cases of violation of the text or spirit of ISW-EM’s Articles of Incorporation and/or Bylaws or harassment of another member after the following due process steps have been taken:
a) A determination is made by the Board of Directors that a violation of the text or spirit of the Articles of Incorporation and/or Bylaws or an incidence of harassment against another member has taken place based on a written and signed charges presented to the Secretary or the President.
b) A written (paper or electronic) notice of the violation is presented to the charged member with an opportunity to present their point of view in person or in writing to the Board of Directors within 15 days of the said notice.
c) Following the hearing or after the 15 day notice period has expired, the Board of Directors shall decide in a closed meeting to clear, reprimand, suspend or terminate the membership of the charged member. The charged member shall be provided a written (paper or electronic) notice of the action.
d) Following receipt of the notice, the member shall have a time period of 15 days to appeal the decision to the Active Membership by presenting a written notice to the Secretary or the President formally requesting the initiation of the appeal process.
e) If an appeal is filed within the prescribed time period, a meeting of the Active Members shall be held, unless the said action is withdrawn by the Board of Directors or the charged member. At this meeting both the charged member and a representative of the Board of Directors shall be provided an opportunity to present their respective point of views. The Active Members shall then make a decision in this matter that shall be final and binding. If the minimum quorum for Active Member meeting is not reached then the decision of the Board of Directors shall stand.
